Apple Resumes Selling Watch Series 9 and Watch Ultra 2 After a Ban

Apple secured a court order to pause the sale-ban on Watch Series 9 and Watch Ultra 2, and resume sales of both these models today across it’s retail stores and official website.

The sale of Apple’s latest smartwatches was banned due to patent infringement concerning the blood oxygen saturation feature – to which the company is willing to make the necessary changes to, soon.

Patent Infringement on a Watch Feature

Just when Apple hoped to make good sales in this year’s holiday, a patent infringement by the medical device maker Masimo hit the company hard. An order from the US International Trade Commission ruled that Apple infringed upon Masimo’s blood oxygen saturation feature on it’s Watch Series 9 and Watch Ultra 2 and, thus, should be banned.

This led Apple to pull both models from it’s retail stores and website last week, ahead of the ban date of December 26th, 2023, while also appealing the decision of USITC and it got lucky, as a federal court has now paused the ban of Watch Series 9 and Watch Ultra 2 just a day after the actual ban date.

As Apple is willing to make the necessary changes to settle the infringement, the US Customs office will make a final call to decide whether the new changes are satisfactory, and let it sell these smartwatches. Well, since it’s scheduled to happen on January 12, 2024, Apple could resume selling the concerned models until then.

Some of the company’s offline stores have already resumed the sales, right after the latest order, while the online sales have now went live. Well, the ban was only applicable to Apple’s retail stores and website, whereas the third-party sellers are exempted from it, letting them sell these models until their stock runs out.
